Sticker.ly Content Guidelines

Effective Date: April 17, 2024

These Guidelines apply to your use of our Service (as defined in the Terms of Use). Your content uploaded and published on Sticker.ly are “User Content” under our Terms of Use. Please refer to the Terms of Use for other provisions applicable to User Content. Capitalized terms not defined in the Guidelines are defined elsewhere in the Terms of Use. By creating and publishing User Content, you agree to be bound by the Terms of Use, including these Guidelines.

1. Content Guidelines

1.1. Intellectual Property Rights. You must own all of the copyrights and other intellectual property rights to your uploads, and your User Content must not infringe on the copyright, trademark, or publicity right of any other party, or you must have sufficient ownership or other intellectual property rights required to upload the User Content consistent with these terms. Posting, distributing or transmitting copyrighted content without the copyright holder’s consent is not allowed. Any unauthorized content you share on our Service may be subject to a take-down by the rights holder(s) to remove the infringing content as set forth below in the Section titled “Process for Reporting Copyright Infringement”.

1.2. User-Identifying, Abusive or Hateful Content. You may not reveal another user’s personal information (real name, contact information, address, social security numbers, etc.). Malicious, abusive, or hateful content or comment that promotes or encourages violence, or incites hate towards individuals or groups based on race, ethnic origin, religion, disability, gender, age, veteran status, sexual orientation, gender identity, political orientation, etc. is not allowed. This includes the use of hate speech symbols without meaningful context.

1.3. Mature or Sexual Content. Content that contains nudity or is intended to be sexually gratifying is not allowed. This includes, but is not limited to, full and partial nudity, as well as graphic depictions of sexual acts.

1.4. Violent or Graphic Content. We do not allow graphic depictions of gratuitous violence or content that promotes acts of violence. Examples of prohibited content include: Brutal, extended, graphic acts of violence. ii. Depiction of sexual assault or forced sexual abuse, or glorification/promotion of inflicting harm on other persons or animals. iii. Glorification or promotion of self-harm or suicide. iv. Instructional content about the assembly, enhancement, or acquisition of guns, weapons or explosives. v. Denialism or minimization of crimes against humanity, provocation to commit acts of terrorism.

1.5. Dangerous or Illegal Content. Content that is encouraging, promoting, or soliciting dangerous or illegal activity is not allowed. Examples of dangerous or illegal content include, but are not limited to: i. Spreading misinformation. ii. Content with themes of incest and grooming. iii. Glorification or promotion of illegal substances or drug use.

2. Potentially Unlawful Content and Conduct

We reserve the right to remove content and discipline conduct that we deem, in our sole discretion, to be harmful or potentially unlawful. Examples of harmful or potentially unlawful content or conduct include (i) defamatory content or conduct, (ii) factually false or deceptive content or conduct, (iii) content or content that violates the privacy rights of another person, and (iii) content or conduct that violate the applicable laws or are prohibited by law.

3. Reporting User Content

To report User Content that violate the Guidelines or our Terms, click on three dots next to sticker packs/creator profile and the “Report” button. Reported material may be reviewed by our moderation team, and comments, Posts or other content of Creator Profiles in violation of our policies may be removed. NAVER Z reserves the right to take further measures, such as blocking the creator from posting content and/or blocking its account.

4. Reporting Copyright Infringement

Content that infringes on the copyright of others is not allowed on Sticker.ly. You should only create, post, and share content on Sticker.ly that you own, or that you otherwise have rights to or are authorized to create, post, and share on Sticker.ly. Rights holders may request that Sticker.ly remove unauthorized contents. Contents that infringe copyrighted content of others may be removed and persistent violations of our policies may result in a permanent suspension of the account. If multiple copyright complaints are received about an account, or other evidence suggests a pattern of repeat infringement, Sticker.ly may suspend that account in accordance with our policies.

Copyright Infringement Notification

Copyright holders have the right to prohibit others from copying or distributing the original creation. As a copyright owner, you may file a Copyright Infringement Report to request removal of the infringing content from Sticker.ly platform - please complete the report form and attach the file when submitting the request. Failure to include necessary information may limit our ability to investigate your claims and may result in your complaint being denied. Prior to submitting a copyright infringement report to Sticker.ly, directly communicating with the user may result in a prompt resolution of your complaint.

It is important to know that only the owner of the intellectual property rights or their designated representative may file a copyright violation report. Please note that if you believe contents on Sticker.ly infringes someone else’s intellectual property, you may directly inform the rights owner.

Sticker.ly may provide your contact information to the person who posted the content that you are reporting as well as the details of the complaint.  If you are concerned about your contact information being shared, you may prefer to provide your business or professional contact info or wish to appoint an agent to report for you.

Submitting a report of intellectual property infringement is a serious matter with potential legal consequences. Intentionally submitting fraudulent or misleading reports of copyright or trademark infringement may lead to liability for damages under section 512(f) of the United States Digital Millennium Copyright Act (DMCA) or similar laws as may be applicable in other countries as well as Sticker.ly taking action, including termination of your account.

Sticker.ly is not in a position to arbitrate, mediate and resolve disputes between third parties, and may not be able to remove the content or suspend the account you reported.

Counter Notification

Sticker.ly accepts counter notification for copyright infringement reports. If you receive a notification of infringement and have a good faith belief that you are authorized to use the content or the notification is a result of misidentification or mistake, you may submit the counter notification to Sticker.ly via our Counter Notification Form - please complete the notification form and attach the file when submitting the request. Failure to include necessary information may limit our ability to investigate your claims and may result in your counter-notification being denied.

Please note that, when Sticker.ly receive a counter notice, we will provide the entire counter-notification to the original reporter, including any contact information you provide. We encourage you to consult with a legal professional if you are not sure to file a counter notification.

5. Reporting Trademark Infringement

Content that infringes on the trademarks of others is not allowed on Sticker.ly. We do not allow unauthorized use of a trademark in connection with goods or services that is likely to cause confusion, deception or mistake about the source, origin, sponsorship or affiliation of the associated goods and/or services. Sticker.ly may remove User Content that infringe others’ trademark rights. You should only create, post, and share content on Sticker.ly that you own, or that you otherwise have rights to or are authorized to create, post, and share on Sticker.ly. Rights holders may request that Sticker.ly remove unauthorized contents. User Content that infringes trademarks of others may be removed and persistent violations of our policies may result in a suspension or termination of the account. If multiple trademark complaints are received about an account, or other evidence suggests a pattern of repeat infringement, Sticker.ly may suspend that account in accordance with our policies. It is important to know that only the owner of the intellectual property rights or their designated representative may file a trademark violation report. Please note that if you believe contents on Sticker.ly infringes someone else’s trademark, you may inform the rights owner. Sticker.ly is not in a position to arbitrate, mediate and resolve disputes between third parties, and may not be able to remove the content or suspend the account you reported.

Trademark Complaint and Notification

Prior to submitting a trademark violation report to Sticker.ly, directly communicating with the user may result in a prompt resolution of your complaint. You may file a Trademark Infringement Report to request removal of the alleged infringing content from Sticker.ly - please complete the report form and attach the file when submitting the request. Failure to include necessary information may limit our ability to investigate your claims and may result in your complaint being denied. Please note that only the intellectual property rights owner or their authorized representative may file a report of trademark infringement. If you believe something on Sticker.ly infringes someone else’s trademark rights, you may want to let the rights owner know.

Sticker.ly may provide your contact information to the person who posted the content that you are reporting as well as the details of the complaint.  If you are concerned about your contact information being shared, you may prefer to provide your business or professional contact info or wish to appoint an agent to report for you.

Sticker.ly accepts counter notification for trademark violation reports. Please note that, when Sticker.ly receive a counter notice, we will provide the entire counter-notification to the original reporter, including any contact information you provide. We encourage you to consult with a legal professional if you are not sure to file a counter notification.

6. Violation of the Guidelines and Terms

6.1. In addition to any remedies available to us in the Terms, we reserve the right to take any action we deem appropriate in response to violations of this Guidelines. Users who violate this Guidelines may be suspended from posting or submitting User Content (temporarily or permanently) or have their account and access to the Services suspended or terminated.

6.2. While we generally attempt to provide advance notice to users of actions we take in response to Guidelines violations, we may elect not to do so at our sole discretion. As a result, violations of Guidelines or the Terms may result in permanent loss of User Content and other content previously accessible through the Services.

6.3. If your User Content has been removed or suspended due to Guidelines violations, you may contact our team at support@sticker.ly. However, please note that we do not offer an appeal process for actions we take in response to violations of this Guidelines.
